Clause 1 – “Customer” shall be understood to mean any natural or legal person who has concluded or wishes to conclude an agreement or contract with IAE ENGLISH ASIA / IAE Ltd. The Commercial Terms and Conditions of IAE ENGLISH ASIA / IAE Ltd are applicable to all documents, and to orders and the performance thereof, whether they were drawn up before or after said documents were drawn up.
Clause 2 – These General Terms and Conditions of Sale govern the entirety of the relationship between IAE ENGLISH ASIA / IAE Ltd and its customers, except where there is an exemption expressly agreed in writing by IAE ENGLISH ASIA / IAE Ltd. In the event of contradiction, our General Terms and Conditions of Sale take precedence over those of the customer at any time, even where otherwise stipulated.
Clause 3 – Starting from his/her registration, the customer is permanently and irrevocably committed to IAE ENGLISH ASIA, / IAE Ltd irrespective of payment of a deposit and subject to clauses 4 and 5 below.
Clause 4 – Any customer has the right to cancel his/her registration for a course or workshop, exclusively in writing. In that event and if a deposit or the full sum for a session has been paid, IAE ENGLISH ASIA/ IAE Ltd will refund the sum paid, less cancellation fees, namely: HKD400 for a cancellation taking place up to 4 weeks before the start of the session; HKD800 for any cancellation taking place between 4 and 2 weeks before the start of the session; and no refund for any cancellation taking place less than 2 weeks before the start of the session. No refund will be issued for cancellation of Taster Workshops. This does not apply to those booking a CLEAR or Checkpoint assessment.
Clause 5 – IAE ENGLISH ASIA/ IAE Ltd will not perform any refunds for any cancellation taking place on or after the start of a session cycle or examination and the customer will remain required to pay the course price in full. In relation to bespoke services and one-on-one courses, any course that has not been cancelled at least one business day before the date set shall be deemed to have been performed and will therefore be invoiced. This possibility of cancellation without charge is valid on a maximum of four occasions per course session ordered. Over and above four cancellations, all courses will be invoiced.
Clause 6 – In the event that the number of persons registered for a course or session is lower than the minimum, as specified in the course details, IAE ENGLISH ASIA / IAE Ltd reserves the right either to cancel the session, subject to reimbursement of the entire sum paid by the customer for that session, or to suggest an alternative date.
Clause 7 – The prices mentioned on the IAE ENGLISH ASIA / IAE Ltd website shall be understood to include all taxes. Like the schedules, they are merely for information purposes and IAE ENGLISH ASIA reserves the right to amend them. In that event, IAE ENGLISH ASIA undertakes to give the client written notice thereof.
Clause 8 – The registration fee is payable no later than the last business day prior to the date of the course or session. IAE ENGLISH ASIA / IAE Ltd reserves the right to refuse access to the course to any person not having paid the balance of their registration fee, without prejudice to the claim of IAE ENGLISH ASIA / IAE Ltd for full payment of the registration fee.
Clause 9 – You may reschedule your CLEAR/Checkpoint assessment up to 15 days before the assessment date at no additional cost.
Clause 9.1 – Should you wish to reschedule your workshop 14 days prior to the registered assessment date, then IAE will deem this session as cancelled and the registration fee as forfeit. A new registration fee will then apply.
Clause 9.2 – IAE will not perform any refunds for CLEAR/Checkpoint assessments cancelled or rescheduled 14 days prior to the registered assessment date.
Clause 9.3 – If the candidate fails to produce sufficient ID on the day of assessment in the form of a valid passport or HK ID IAE reserves the right to turn the candidate away. In such instances the full fee may be charged. The candidate will then be asked to reschedule and provide another fee.
Clause 9.4 – IAE Ltd reserves the right either to cancel the CLEAR/Checkpoint assessment, subject to reimbursement of the entire sum paid by the customer for that session, or to suggest an alternative date.
Clause 10 – The invoices of IAE ENGLISH ASIA / IAE Ltd are payable in cash. Late-payment interest of 1% per month as well as a fixed indemnity of 10%, with a minimum of HKD300, will be applied, by operation of law and without the need for a formal demand, to any sum remaining unpaid at due date.
Clause 11 – Any person giving up a course, session or examination remains liable for the full registration fee for that course, session or examination.
Clause 12 – The premises and materials put at the disposal of the participants for their course shall be used in a responsible manner. The negligent person shall be liable for all damage. IAE ENGLISH ASIA / IAE Ltd reserves the right to deny access to a course to a participant whose behavior prevents the other members of his/her group from pursuing their course or examination in the normal manner. Any exclusions for disciplinary reasons will be without refund or indemnity.
Clause 13 – IAE ENGLISH ASIA / IAE Ltd may not, in any event, be held liable for damage caused to the personal property of a customer by another person or for any thefts that may be committed on the occasion of a course.
Clause 14 – Any complaints shall be received at the registered office of the company, by registered post, no later than 7 days after the start of the course or session.
Clause 15 – The customer may appeal for a review of the overall test score received on the CLEAR certificate. The customer must submit, in writing, an appeal for a review to the test centre manager. The customer must submit a letter of appeal within four weeks of issue of the certificate. The letter must clearly state the following:
- Test taker's full name (the same name used in the test)
- Test centre
- Test date
- Test taker number
- Payment of the review fee
- Original test certificate
- The reason for the review
The fee to have a review is HKD1,920 payable to “IAE English Asia Ltd”. The fee must sent with the appeal letter. The review process may take several weeks.
An external examiner conducts the review. If the review results in:
- No change to the score; we will charge the review fee, and we will return the certificate to the customer.
- An increase to the score; we will not charge the review fee, and we will send the customer a new certificate.
- A decrease to the score; we will charge the review fee, and we will issue a new certificate.

Clause 16 – Starting from the fourth cancellation during a single course or session of a course, any further cancellation is automatically invoiced, regardless of the period of time separating the cancellation and the planned date of the cancelled lesson.
Clause 17 – Some information collected on the registration form will be included in a “customer file” managed by IAE ENGLISH ASIA / IAE Ltd. The customer can obtain notice of the information relating to his/her person from IAE ENGLISH ASIA / IAE Ltd. He/she can obtain rectification of any erroneous information and/or removal of this information from the file.
Clause 18 – These General Terms and Conditions of Sale are subject to the law of the Hong Kong Special Administrative Region of the People's Republic of China. In the event of legal action, only the courts of the legal district of Hong Kong shall be competent.
